Mayo native, Enoch Burke has asked the High Court to place a stay on the full hearing of a legal action taken against him by his school.

In early September, the secondary school teacher was sent to prison for breaching an injunction not to attend Wilson's Hospital School in Co Westmeath.

He was suspended on full pay at the end of August pending the outcome of an investigation into alleged misconduct, allegedly arising from his refusal to use the pronoun, 'they,' when referring to a gender transitioning student with the pronoun, 'they'.

He was jailed for contempt for breaching a court order to stay away from the school until the process is complete, but he's due to appeal that decision in February.

Before the High Court today, he submitted that his appeal should be heard before the trial of the action.

A decision will be made at a later date
